1. Agreement to Terms

By accessing or using the ZImage website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Intellectual Property & Ownership

2.1 Your Generations

You retain full ownership of all images and content you generate using the Service ("Generations"). We hereby assign to you all rights, title, and interest in and to such Generations for any commercial or non-commercial purpose, subject to your compliance with these Terms and the law.

2.2 Platform Rights

By using the Service, you grant ZImage a non-exclusive, worldwide, royalty-free license to host, reproduce, and display your Generations solely for the purpose of providing and improving the Service (e.g., displaying your history, processing requests).

2.3 Service Materials

The Service itself (excluding your Generations), including its original content, features, and functionality, are and will remain the exclusive property of ZImage and its licensors.

3. Subscriptions and Payments

3.1 Billing

Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms as we may update them from time to time.

3.2 Subscriptions

Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless canceled. You authorise us to charge your payment method for the renewal term.

3.3 Cancellations

You may cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current paid term.

3.4 Refunds

Please refer to our Refund Policy for details regarding refunds. Generally, used credits are non-refundable.

4. Prohibited Uses

You may not use the Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts.
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate.
  • To submit false or misleading information.

AI Generation Policy

You strictly agree NOT to use the Service to generate, produce, or share content that:

  • Depicts child sexual abuse material (CSAM) or exploitation of minors.
  • Promotes violence, hate speech, or illegal acts.
  • Infringes on the intellectual property rights of others.
  • Is sexually explicit, pornographic, or "NSFW" (Not Safe For Work) in a manner that violates applicable laws.
  • Depicts non-consensual sexual content or "deepfakes".

Violation of this policy will result in immediate account termination and reporting to relevant authorities.

5. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service utilizes Artificial Intelligence, and we make no guarantees regarding the accuracy, reliability, or suitability of the generated content. You understand that AI may occasionally produce offensive or inaccurate content, and you agree to use the Service at your own risk.

6. Limitation of Liability

In no event shall ZImage, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of America, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
